Kochi: Asked at a talk on ‘Horse Trade and Democracy’ organised by the All India Lawyers Union how the Indian position compares with other parliamentary systems, Senior Advocate Kapil Sibal drew a contrast with the United States, the United Kingdom and Europe, where in his account a legislator elected on one party’s ticket retains a genuine choice about how to vote. He illustrated it with the American practice of cross-party negotiation on individual pieces of legislation, and attributed the Indian difference to the pull of office, the desire for advancement within the party being strong enough that members follow the direction regardless. AIMIM president Asaduddin Owaisi on Monday criticised Union home minister Amit Shah’s announcement that BJP-led NDA governments in 21 states would introduce the Uniform Civil Code (UCC) before 2029, questioning whether the ruling alliance’s partners had an independent political voice. In a post on X, Owaisi said NDA allies should prove that they were not merely “choti BJP”. He also cited the Law Commission appointed by the NDA government, saying it had concluded that the UCC was “neither necessary nor desirable”. “The soul of this country is its pluralism,” Owaisi said, arguing that a Uniform Civil Code would amount to imposing Hindu law on non-Hindus. He criticised BJP-ruled states for laws such as the Disturbed Areas Act, which he alleged restricted property transactions between Muslims and Hindus. He also alleged that so-called “love jihad” laws had been used exclusively against Christians and Muslims. “A UCC isn't about equality; it's about targeting Muslims,” Owaisi said. As reported by HT earlier, Shah made the UCC announcement in Mumbai on Sunday while speaking about the BJP’s ‘Seva Sankalp Abhiyan’, a month-long nationwide outreach campaign marking Prime Minister Narendra Modi’s 25 years in public life and power. “We introduced the Uniform Civil Code in several states. I am confident that we will implement the UCC in all 21 states governed by the BJP-led NDA before 2029,” Shah said.

Kerala HC grants relief to woman denied use of frozen embryos by IVF hospital after her husband's death The Kerala High Court recently came to the aid of a 43-year-old widow who was denied the use of embryos she had preserved along with her husband during his lifetime at a hospital for assisted reproduction or In Vitro Fertilisation (IVF). The hospital, which had refused to give the widow the frozen embryos, claimed that there was no clear indication of whether her husband wanted them to be handed over to his wife following his death. The consent form signed by the couple only envisaged three scenarios about the fate of the embryos if either spouse were to die: (i) that the embryos be used by an unknown couple (ii) that the embryos be used for research or (iii) that the embryos be destroyed. Left with only these three options, the husband had opted for the use of the embryos by an unknown couple. Justice Harishankar V Menon noted that no option was given for the handover of the embryos to the wife. The judge also pointed out such a consent form deviated from the prescribed format in which consent was supposed to be taken from couples undergoing IVF. Under the relevant rules, an option has to be provided for the handover of the embryos to the surviving spouse if either spouse were to die. The Court concluded that husband, in this case, clearly intended for the embryos to be put to use rather than destroyed.
